Article IV. SMOKING IN PUBLIC PLACES; PLACES OF EMPLOYMENT |
§ 12-54. Exemptions.
The following types of establishments are exempted from the smoking prohibition of this article:
(1)
Bars (except a bar which derives more than thirty (30) percent of its annual gross revenue from the service of food);
(2)
Retail tobacco stores.
(3)
A place of employment may designate an exterior or interior area as a "smoking area." A smoking area shall be separate from an area designated or normally used as an employee dining or break area. An interior smoking area must be enclosed area as defined in section 12-52 and sufficiently ventilated to preclude the escape of smoke into other areas of the workplace. An exterior smoking area shall not be allowed at any entrance to a building which is typically used by the public.
