§ 14-152. Surveillance cameras required.

  • (a)

    Every fast food restaurant, filing station, convenience store, and package store which commences operation on or after January 1, 2013, shall have installed, and shall maintain in good working order, one or more surveillance cameras providing a clear and unobstructed view of the check out/cash register(s) area of the establishment, with sufficient definition and lighting to recognize the face of the customer and clerk, no later than July 1, 2013. The video recorded by the camera(s) shall be maintained by the store for at least thirty (30) days in digital or other format readily accessible.

    (b)

    Fast food restaurants, filing stations, convenience stores, and package stores existing and in operation before January 1, 2013, are exempted from the requirement for installation and maintenance of surveillance cameras, but are encouraged to install and maintain surveillance cameras as described above. Provided, that for any such exempted establishment, if in a preceding calendar year there shall be in excess of five (5) calls for police assistance to the location which result in reports of criminal activity required to be included in the police department's crime statistics for the year, the establishment shall no longer be exempt. The chief of police shall provide written notice that as a consequence the establishment shall be required to comply with the provisions of this article for the installation and maintenance of surveillance cameras, and subject to all penalties for a violation of the requirement. The notice shall further state that the establishment shall have six (6) months of the date of the notice to install and maintain surveillance cameras in compliance with the provisions hereof.

    (c)

    All establishments covered by this article and establishments voluntarily utilizing surveillance cameras shall display prominently a sign stating, "These premises protected by surveillance cameras."
