§ 19-122. Sick leave bank for non-uniformed employees.

  • (a)

    There is hereby established a "sick leave bank" for the use of non-uniformed employees. Non-uniformed employee means an employee who is not a firefighter or sworn police officer, and who, by virtue of his or her employment, is automatically eligible to participate in the bank.

    (b)

    The sick leave bank shall be administered by a committee consisting of the director of the human resources department, a representative designated by the city attorney, and a representative of the mayor's office, who shall preside as chair. The committee is charged with developing uniform criteria for the allocation of sick leave from the bank, which shall be approved by the city council and distributed to all non-uniformed employees.

    (c)

    Any non-uniformed employee who has been employed as least one (1) year with the city and who has earned sufficient sick leave, may elect to contribute in normal work shift increments. The maximum contribution to the sick leave bank shall be eighty (80) work hours for a non-uniformed employee. The employee may elect the contribution on a form to be developed by the administering committee, which shall be signed by the employee. Once a contribution is made it is irrevocable.

    (d)

    A non-uniformed employee is eligible to apply for sick leave from the sick leave bank if he or she:

    (1)

    Is in good standing with his or her department;

    (2)

    Has exhausted all paid annual and sick leave and other compensatory time;

    (3)

    Submits written verification from his or her treating physician that the employee is incapable of returning to work in any capacity at the time all leave and compensatory time has been exhausted;

    (4)

    The illness or injury is not job related or covered by worker's compensation. An employee may receive a maximum of two hundred forty (240) hours of sick leave from the sick leave bank in any 12-month period. An employee need not have personally contributed to the sick leave bank to be approved for or receive sick leave from the bank.

    (e)

    The administering committee of the sick leave bank may approve sick leave for any non-uniformed employee who meets the criteria set forth in subsection (d) at the time this section goes into effect. It shall make quarterly reports to the mayor and city council of the balance of hours in the sick leave bank. The balance of hours in the bank should not exceed ten thousand (10,000).

    (f)

    No non-uniformed employee shall be required to contribute to the sick leave bank. Once hours are contributed, the amount contributed will be subtracted from the employee's earned sick leave allocation and he or she will no longer have any right to the use of the hours or entitled to compensation upon retirement for the hours contributed.
