§ 24-63. Form of notice to owners.

  • (a)

    The notice to be given by the city council to property owners, as above provided, shall be in substance as follows: tabs msp 1477

    Sir:

    You are hereby notified that unless you construct, reconstruct or repair, as the case may be, a sidewalk and curb in front of (here describe property) within twenty (20) days from the service of this notice, in accordance with chapter 24, article II, the same will be (reconstructed or repaired) by us under a contract with some suitable person, and the cost thereof, together with six (6) percent added thereto and six (6) percent interest and cost, shall constitute a charge against you and shall be assessed as a lien on the property herein described from the date of the commencement of said work, which charge and lien will be assigned to the said person or persons doing said work, or to other persons if so desired by the city, said charge to be recovered and said lien to be foreclosed in appropriate suits against you as provided by law; provided that the city is authorized to accept the actual cost of said work without penalty or interest if the same be paid within ten (10) days after the completion of said work. tabs bottom, 1478

    (b)

    The notice provided for in subsection (a) of this section shall be served upon the property owner by delivering him a copy thereof or, if he refuses to receive it, by offering a copy thereof to him or by leaving a copy of the notice at the usual place of abode of the owner, with some person who is over sixteen (16) years of age and a member of his family. If the owner is not to be found in the city, or if the owner is unknown, service shall be made by delivering a copy to the known agent in charge of the property and if there be no known agent in the city, service shall be had by affixing a copy thereof to the property in some public part thereof, or by publishing a copy thereof in some daily or weekly newspaper published in the city for one (1) insertion. Such notice may be served by the city engineer or any member of the police department and the endorsement upon such notice by the officer serving the same shall be sufficient evidence of his action in the premises.
