§ 25-94. Formal acceptance by the city.

  • (a)

    After the city engineer has inspected the work and indicated to the developer that the streets and utilities conform to approved plans, the developer shall give a formal notice of completion to the city. This notice shall be in writing and shall be accompanied by the as-built drawings, payment, performance bonds, and all fees that are due.

    (b)

    Approval of final plat by the commission shall be deemed acceptance of any dedication shown on the plat. These dedications shall be accepted by the city or county as prescribed by law.

    (c)

    No street or alley, which shall hereafter be dedicated to public use by the proprietor of grounds in the city, shall be deemed a public street or alley, or to be under the care or control of the city council, unless the dedication shall be accepted and confirmed by an ordinance especially passed for that purpose.
