§ 28-81. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Act shall mean The Clean Water Act (33 U.S.C. 1251 et seq.), as amended.

    Authority shall mean the city wastewater utility.

    BOD (denoting biochemical oxygen demand) shall mean the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at twenty (20) degrees Centigrade, expressed in milligrams per liter.

    Building drain shall mean that part of the lowest horizontal piping of a drainage system which receives the discharge from other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five (5) feet (1.5 meters) outside the inner face of the building wall.

    Building sewer (service line) shall mean the extension from the building drain to the property line. That section of the existing building sewer between the property line and the main sewer line shall be maintained by the city's wastewater utility.

    Combined sewer shall mean receiving both surface runoff and sewage.

    Cooling water shall mean the water discharged from any use or source such as air conditioning, cooling or refrigeration; or to which the only pollutant added is heat.

    Discharger shall mean any user who discharges any effluent into the sanitary sewer by means of pipes, conduits, pumping stations, force mains, constructed drainage ditches, and all constructed devices and appliances appurtenant thereto.

    EPA or Environmental Protection Agency shall mean United States Environmental Protection Agency.

    Garbage shall mean solid wastes from the domestic and commercial preparation, cooking, and dispensing of food, and from the handling, storage, and sale of produce.

    Grab sample shall mean a sample which is taken from a waste stream on a one-time basis with no regard to the flow in the waste stream and without consideration of time.

    Indirect discharge shall mean the discharge or the introduction of any domestic or nondomestic pollutants in the sanitary sewer system from an indirect source.

    Industrial discharger shall mean a discharger who discharges industrial wastes.

    Industrial waste shall mean the liquid, solid, or gas wastes from, but not limited to, industrial manufacturing processes, trade or business which is distinct from sanitary sewage.

    Interference shall mean a discharge which, alone or in conjunction with a discharge from another source:

    (1)

    Disrupts the treatment facility or its operations including sludge use and disposal.

    (2)

    Causes the treatment facility to violate its NPDES permit.

    National categorical pretreatment standard or pretreatment standard shall mean any regulation containing pollutant discharge limits promulgated by the EPA in accordance with section 207(b) and (c) of the act which applies to a specific category of industrial users.

    Natural outlet shall mean any outlet in a watercourse, pond, ditch, lake, or other body of surface or ground water.

    NPDES shall mean the national pollutant discharge elimination system permit program as administered by the USEPA or state.

    O and M shall mean operation and maintenance.

    Other wastes shall mean decayed wood, sawdust, shavings, bark, leaves, refuse, ashes, garbage, offal, oil, tar, and all other substances except sewage and industrial wastes.

    Pass through shall mean wastewater which enters and exits a treatment facility and is discharged into navigable waters in quantities or concentrations which, alone or in conjunction with other wastewater, causes violations with the treatment facility's NPDES permit.

    pH shall mean the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.

    POTW shall mean any sewage treatment works and the sewers and conveyance appurtenances discharging thereto, owned and/or operated by the city.

    Pretreatment shall mean the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharging or otherwise introducing such pollutants into a POTW.

    Properly shredded garbage shall mean the wastes from the preparation, cooking, and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch (1.27 centimeters) in any dimension.

    Public sewer shall mean a sewer in which all owners of abutting properties have equal rights, and is controlled by public authority.

    Sanitary sewer shall mean a sewer which carries sewage and to which storm, surface, and ground waters are not intentionally admitted.

    Sewage shall mean a combination of the water-carried wastes from residences, business buildings, institutions, and industrial establishments, together with such ground, surface, and stormwater as may be present.

    Sewage treatment plant shall mean any arrangement of devices and structures used for treating sewage.

    Sewage works shall mean all facilities for collecting, pumping, testing, treating, and disposing of sewage and sewage sludge.

    Sewer shall mean a pipe or conduit for carrying sewage.

    Slughold shall mean any substance released in a discharge at a rate and/or concentration which causes interference to a POTW.

    Storm drain or storm sewer shall mean a sewer or ditch which carries storm and surface waters and drainage, but excludes sewage and industrial wastes, other than unpolluted cooling water.

    Superintendent shall mean the superintendent or director or manager of the wastewater utility or water pollution control department of the city or his authorized agent, deputy, or representative.

    Toxic pollutants shall include, but not be limited to, those substances listed in section 28-104.

    TSS or total suspended solids shall mean the weight in milligrams per liter (mg/l) of filterable residue left on a standard glass fiber filter which has been dried at one hundred three (103) to one hundred five (105) degrees Celsius for one (1) hour.

    Upset shall mean an exceptional incident in which a discharger unintentionally and temporarily is in a state of noncompliance with the standards set forth in this division, due to factors beyond the reasonable control of the discharger, and excluding noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation thereof.

    Wastewater shall mean industrial waste, or domestic sewage or any other waste, including that which may be combined with any groundwater, surface water or stormwater, that may be discharged to the POTW.
