§ 29-4. Penalties for violation.

  • (a)

    Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a misdemeanor. After the expiration date indicated by the notice of violation, any person who violates this chapter or fails to comply with any of its requirements shall upon conviction thereof be fined not more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days, or both, and in addition shall pay all costs and expenses involved in this case. After the expiration date indicated by the notice of violation, each day such violation continues shall be considered a separate offense.

    In addition to the foregoing penalties, an automobile salvage yard found in violation of any provision of this chapter, with said violation continuing for a period exceeding one hundred eighty-three (183) days, may be assessed an additional penalty of one hundred fifty dollars ($150.00) per day, beginning on day one hundred eighty-four (184), for each day the violation continues, with said penalty to be cumulative for each and every individual violation.

    (b)

    The owner or tenant of any building, structure, premises or part thereof, and any architect, builder, contractor, agent or other person who willfully commits, participates in, assists in, or maintains such violation may each be found guilty of a separate offense and suffer the penalties herein provided.

    (c)

    Nothing contained in this chapter shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation.
