§ 2-159. Waiver of competitive bidding.
(a)
The city council may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical.
(b)
Emergency purchases. When the public health, safety, and welfare of the city are threatened and the need for immediate action precludes use of regular procurement procedures, the mayor may authorize a department head to make the needed purchases of materials, supplies, apparatus, equipment or things to meet the emergency. The circumstances of the emergency shall be fully documented by the mayor and department head. Requisitions and purchase orders in such cases shall be prominently labeled as "emergency request" or "emergency purchase." A prompt report of the circumstances and all purchases made to meet the emergency shall be made to the city council at first opportunity and the council must ratify and approve all purchases which exceed ten thousand dollars ($10,000.00).
(c)
Whenever the expenditure is to purchase goods manufactured by the Arkansas Department of Correction, and the expenditure is less than twenty thousand dollars ($20,000), the requirements of section 2-157 are waived if authorized by the mayor upon request of the department head.
