§ 10-28. Schedule of positions; powers and duties of the chief of the department.

  • (a)

    There is hereby established and created within the fire and emergency services department the following positions:

    (1)

    One (1) chief of the department.

    (2)

    One (1) assistant chief of the fire and emergency services department, with the position being excluded from civil service coverage and who shall be appointed or removed at the discretion of the chief of the department. An existing member of the department appointed to the position of assistant chief, who shall subsequently be relieved of that position by the chief of the department for any reason not resulting in dismissal, shall return to that member's previous rank and pay.

    (3)

    One (1) executive officer with the rank of captain.

    (4)

    Six (6) battalion chiefs.

    (5)

    One (1) fire marshal with the rank of captain.

    (6)

    One (1) training director with the rank of captain.

    (7)

    One (1) emergency vehicle technician with pay equivalent to that of a lieutenant.

    (8)

    One (1) assistant training supervisor with the rank of lieutenant.

    (9)

    Two (2) assistant fire marshals with the rank of lieutenant.

    (10)

    One (1) public information officer with the rank of lieutenant.

    (11)

    One (1) safety officer with the rank of firefighter.

    (12)

    Seven (7) captains.

    (13)

    Fifteen (15) lieutenants.

    (14)

    Twenty-seven (27) engineers.

    (15)

    One hundred eight (108) firefighters.

    (16)

    One (1) non-uniform budget/human resource officer.

    (17)

    One (1) non-uniform executive administration secretary.

    (18)

    One (1) non-uniform administrative secretary.

    (19)

    One (1) non-uniform fire training academy secretary.

    (20)

    One (1) non-uniform fire prevention secretary.

    (21)

    One (1) non-uniform fire prevention public educator.

    (b)

    The above positions represent the total authorized complement of the fire and emergency services department. They shall perform such duties as are now or may hereafter be prescribed by law and the rules and regulations of the civil service commission or city council (as applicable), and shall obey and execute all lawful orders of the chief of the department. It is understood that authorization of a position does not imply a commitment by the city to fund the staffing of the position.

    (c)

    Powers and duties of the chief.

    (1)

    The head of the department of fire and emergency services shall be the chief.

    (2)

    The chief of the fire and emergency services department shall:

    a.

    Be in direct command of the department;

    b.

    Assign all members of the department to their respective post, shifts, details, and duties;

    c.

    Make and enforce rules and regulations, consistent with Arkansas law, city ordinances, and civil service regulations, concerning:

    1.

    The operation of the department;

    2.

    The conduct of the officers and employees of the department;

    3.

    The uniforms, equipment and training of the officers and employees; and

    4.

    Imposition of penalties for infractions of said rules and regulations.

    d.

    Be responsible for the efficiency, discipline, and good conduct of the department.

    (3)

    Orders of the mayor or the mayor's designee relating to the department of fire and emergency services shall be transmitted in all cases through the chief, or, in the chief's absence or incapacity, through the chief's designee as acting chief.

    (4)

    Disobedience of the lawful commands of the chief of fire and emergency services department, insubordination or other violation of the rules and regulations promulgated by the chief of the department shall be cause for termination or other disciplinary action, consistent with department rules.

    (5)

    It shall be the duty of the chief of the fire and emergency services department to secure the enforcement of all laws and ordinances relating to fire prevention and fire safety, and to issue from time to time regulations for the implementing of said laws and regulations, as allowed by Arkansas law and city ordinance.
