§ 13-3. Rummage or yard sales.

  • (a)

    Any person conducting a rummage or yard sale within the city shall obtain a permit from the city collector and pay the sum established in section 13-89 for the privilege of conducting the sale. A permit shall apply to only one (1) sale and a new permit must be obtained for each rummage or yard sale desired. The permit must be prominently displayed during the sale and available for inspection by any city inspector or police officer.

    (b)

    The permit issued by the city collector shall specify the dates for the which the rummage or yard sale is authorized. The maximum period authorized for a rummage or yard sale is two (2) consecutive days. In the event of inclement weather or an "Act of God" which prevents the permit holder from holding the sale on the dates specified, the permit holder may return to the city collector and obtain a renewal without charge for another date. Only one (1) renewal shall be permitted under this provision and thereafter a new permit must be obtained and the fee paid.

    (c)

    The city collector shall not issue a permit for a location which is not approved by the zoning department. A location may be the site of a maximum of two (2) rummage or yard sales during any thirty-day period.

    (d)

    A person conducting a rummage or yard sale without the required permit or outside the time period authorized by the permit is guilty of a misdemeanor and shall be fined the sum of one hundred dollars ($100.00) per day for each day the sale continues. A person conducting a rummage or yard sale at location not approved by the zoning department, or which has been the site of more than two (2) sales within the preceding thirty (30) days, shall be guilty of a misdemeanor and shall be fined the sum of one hundred dollars ($100.00) per day for each day the sale continues.

    (e)

    The provisions of this section shall be enforced by the inspection and police departments.
