§ 2-206. Findings and determinations.

  • The city council of the city hereby finds and determines:

    (1)

    There exists within and near the city a shortage of necessary wastewater and sewage collection, treatment and disposal facilities to adequately provide for the needs of the citizens and residents of the city, which needs cannot reasonably be met by presently available facilities.

    (2)

    The availability of financing to assist in the constructing, acquiring or equipping of waterworks and sewer facilities will be aided by the providing of funds for financing of such facilities by the creation of a public facilities board pursuant to the provisions of the Public Facilities Boards Act [A.C.A. § 14-137-101 et seq.].

    (3)

    The providing of financial assistance in order to enable the constructing, acquiring or equipping of wastewater and sewage collection, treatment and disposal facilities within or near the city is a proper public purpose as declared by such act and this determination of the city council.
